    My brother, using a crosswalk was hit by a full sized pickup truck going 45 mph, all other traffic was stopped he got in the turn lane to go around everyone, not even thinking of why they had stopped. When he got to the hospital the doctor said straight out when he was told what happened, he thought it was going to be a quick check and then prep the Morgue. When my brother came in they couldn't believe the little amount of damage to his body, they expected pieces of body parts not a full body awake and telling jokes. The nurse had to walk out of the room because he said as a joke I feel like I was hit by a truck.

    A state cop gave my 90 year old mother a $114 ticket for improper use of a seat belt. She had the shoulder part of the belt pushed down because it was causing her shoulder pain. He didn't care. He gave her the ticket anyway. What a loser! Because she's on Social Security (fixed income), I had to give her the money so she wouldn't have to be late on her medical bills. 😡👎

    I have two Rottweilers and a bi color German Shepherd. They are always discriminated against. All three are taught in German language and very obedient. My question is with owning two breeds that have a reputation of being very protective of owners and their property can I be liable if they attack an intruder or someone intentionally trying to harm me?

    Jaywalking should be abolished. It's a made-up term created by automakers to throw the blame away from the car driver and forcing it on the pedestrian. They effectively made "being a pedestrian" illegal.

      So if a child ran unknowingly onto this person's driveway, it's the child's fault it was mauled? Get real. Either put your dog in a fenced in yard, in the house or be outside with your dog. It's not that hard. Especially if the dog has already bitten other people

      That is not how it works legally or morally. There is a much bigger difference between trespassing and entering a property for legal purpose such as delivering the mail or visiting a client.

    Well, the insurance will cover it, but the restaurant’s premiums will rise. If it happens more than once, the restaurant may be dropped by the insurance company. But the restaurant is liable. If you run a business, you’re responsible to maintain a safe facility for employees, delivery people, visiting contractors and customers.

    In my injury case I never get to communicate with my lawyer only the paralegal and I tell her about my pain and issues and she tells me she’s not going to ask the lawyer for an authorization for knee pain said I probably was born with arthritis and it wasn’t caused from the accident and I told her my neck was hurting terribly and still declined me getting help mind you at this time I didn’t have health insurance like I do now

    A similar situation happened to me. I got in an accident that I don't remember the actual incident. Died and was revived. Once they found out I was revived, they mailed me a ticket. But according to the police report, the other driver was in the wrong. Because I had no recollection of the incident, they tried to press me for being at fault. Proved them wrong in court. Because I couldn't remember anything, I plead no contest because I legitimately couldn't say what happened or didn't. Judge had me pay the court costs and do a driving course and dropped the tickets. I was 17 at the time and represented myself.

    It’s actually not that weird. And I’m not being a smart ass. But I would not be at all surprised if this driver was drunk or under the influence. Fleeing the scene seems stupid. But if he was under influence he just may have just avoided a dui/dwi charge.

    The driver of a vehicle always has to avoid collision. All other rules are second to that. Claiming your right to runover a person that violate some rule is at least manslaughter. And penalising jaywalking is ridiculous - we removed penalty for that 30 ys ago in my country. However, a person who does jaywalk and cause an accident can of course be held liable for damages in a civil court case

    Hey y'all! I love learning new things! I, too, was under the impression that if you didn't cross at a crosswalk, it was your fault if hit. I was taught that you had to walk with traffic, just like when you're riding a bike. Are there different laws about this in different states? (I doubt it because I think there are standard federal regulations that all states have to follow.) Or was I just taught wrong? Right after my son turned 6, he was hit by a car being driven by an uninsured 19 year old. My son was riding his bike and the driver was going way over the 5 mph speed limit in our apartment complex. He gave me fake insurance information, but by the time I figured that out, he was long gone. My son sustained terrible head and brain injuries. He's almost 30, and except for the giant, hairless horseshoe shaped scar on his head, you'd never know what he went through. Over a year later, I found out that I could have claimed my uninsured motorist policy. The insurance company said that the statute of limitations was up on that and that they didn't have to pay me for it. But, out of the goodness of their heart they would go ahead and pay out the whole $10,000 policy. And then a long time after that, I found out that we could have stacked our policies and gotten another $10,000 from our other insured car. The first judge we had that handled the case, tried to have all of the money sent to the hospital to pay on some of my son's medical bills. I never signed any of the paperwork and it hadn't gone through. Then, that same judge was thrown off the bench when he was found guilty of bribery type misdeeds. So the second judge we ended up with was fantastic! He ordered the money to be deposited into a bank account that couldn't be touched without a court order and couldn't be released until my son turned 19 or 20, I think. The judge also ordered that if there was ever any kind of a big expense that was for my son, we could come to the court and ask to withdraw some of the money. But we never did that. Well, after the money had been in the bank, untouched for 10 years, I got a letter from the bank saying that they were going to seize it because there hadn't been any activity on it. I was absolutely livid because the court order saying that the money couldn't be touched without another court order was attached to his account when we opened it. So, we got in touch with the judge immediately when we found this out, and his grandfather asked the judge if he could take the money out and put it into an interest-bearing account of his choosing. In the 10 years that money had been just sitting there in the bank, he hadn't even earned $20 in interest. And, of course, when the judge said that would be fine, the bank begged us to keep the money there. I told the guy, he should have known better than to even ask. Because the letter they sent, and the way he spoke to me, was just atrocious. It's just a shame that I didn't know that we could have gone to the court and asked for that a lot sooner. Like 10 years sooner!!! Anyway this was a very interesting video, and I hope somebody sees this and can tell me about walking with the flow of traffic. Thanks! I'm in Mississippi, btw.

      Wow, we're so sorry to hear about what your son and your family had to go through, but glad to hear that he's made such an incredible recovery! Laws and ordinances involving pedestrians can differ from state to state, and can even between cities or counties! Unfortunately, many people believe that if they were injured as a pedestrian, especially if they received a citation from a responding officer, that they have no recourse, but this is not always the case. Of course each case is unique and it depends on the individual circumstances, but we want pedestrians everywhere to know that if they're injured, they're not alone, and we're here to talk them through their rights with an attorney for a totally FREE consultation.     It is a restaurants responsibility to make sure that it is safe for all patrions both inside and outside the restaurant. If they know that it wasn't safe for customers and still did nothing to fix it this could result in serious penalties up to and including termination of the restaurant

    Definitely responsible for the patrons being harmed. Even the first patron had a case as the restaurant did not ensure their entrance and exists were safe.

    I was on my motorcycle on a twisting narrow mountain road when a car tried to pass me. He clipped my back wheel and sent me flying onto the shoulder with a broken leg, five cracked ribs, and my bike on top of me. I got his plate number. Fortunately, a couple came along 15 minutes later. They got the bike off me and called for an ambulance. They took me to the hospital where, in the ER, a cop I'd never seen walks in and puts a ticket on the gurney where they were fixing my leg. No gown, no mask, or anything. The ER staff gave him a hard time. He shrugged it off. I asked him, aren't you even going to interview me about what happened? I have the other guy's plate number. He laughed and said, you were driving too fast for conditions there's no skid marks from another car. I was in the hospital 10 days. A week later I had to go to court on the ticket. I told the DA my story, pointed out the cop had not witnessed anything and just made assumptions. She said she'd ask the judge to dismiss because the cop didn't show in any case and told me privately she'd had a lot of problems with that cop being overzealous.

      I had a police officer give me a ticket for "not wearing a seatbelt" the same day I was in the hospital due to the car accident I had. I took it to court, and told the man that had asked me about the ticket that the officer just assumed I didn't wear a seatbelt, and we had a statement from the medical personnel that said I wore a seatbelt, and got it dismissed.

    This is a tragedy. However, why do we continue to put in cross walks, lights and other deterrents for walkers to be safe when it all falls on the driver to make sure walkers are following the rules.

    The Officer didn't know she was dying... he's not a medical professional. Dead bodies aren't put on "stretchers" and put in an ambulance. Ambulances don't transport dead bodies to the morgue. I know 2 people who were killed "Jay walking" and they both died because they chose to disobey the law.
